Defective Tool/Equipment
If the railroad furnishes railroad workers with a tool, a
piece of machinery or other device, that does not work as it is designed
to work and the employee is injured, then the railroad legally caused
the injury. Examples:
1. If a hammer, wrench, handle or other hand held tool is being
used on the railroad in a normal manner and breaks, the railroad
legally caused the injury
2. If a mechanical tool such as a power lift, power wrench, come-along,
etc. breaks or malfunctions or causes injury, the railroad legally
caused the injury.
3. If any machinery that is being used in a normal manner and
malfunctions or breaks causing injury to a railroad worker, then
the railroad legally caused the injury.
